JAMES BAILEY OF ROWLEY BRANCH............First Generation in America

 

JAMES BAILEY, born about 1612 in England came to Rowley in the Massachusetts Bay Colony about 1640.  He married LYDIA EMERY.   He died in Rowley, August 9, 1677.   She died in Rowley, April 29, 1704.

 

JAMES BAILEY was a brother of RICHARD BAILEY, who came to New England in 1638, in the ship "Bevis." 

 

An account of Richard and his descendants was published by Alfred Poor of Salem, MA, in 1858, in a book entitled, "Historical and Genealogical Researches in the Merrimack Valley."

 

Richard Bailey in his will dated in 1648, a copy of which is printed in the Sixth Annual Report of the Bailey-Bayley Family Association, mentions his brother, JAMES, and his nephew, JOHN.   It appears from the town records of Rowley that JAMES BAILEY acquired, by allotment and purchase, considerable real estate, and was a citizen in good standing.   He held various town offices, including the office of Overseer of the Poor, and also that of Selectman for several years.  

 

His house stood on the east side of what is now called Pleasant Street in the village of Rowley, on land now owned by Mr. Charles H. Todd.   The record of the original grant  is as follows:

 

            "To JAMES BAILEY one house lott containing an Acre and an halfe lying on the north side of

            Edward Sawyer's house lott."

JAMES BAILEY (BAYLEY) of Rowley, being weake of body, but perfect in understanding and memory, do make this my last will and Testament in mannor form as followeth, after my debts are paid I do give and bequeath the rest of the Estate, God hath given me as followeth,

 

I do give unto my daughters, LYDIA PLATTS and DAMARIS LEAVER each of them, 20 pounds a peace,

 

and to my daughter, PLATTS, seven pounds more, which is in the hands of Thomas Remington, she to have that seven pounds when it is due the twenty pounds a piece that I do give unto my daughter, to be payd in four years time,

 

Also I do give unto my eldest son JOHN all that land and meadow, and meadow that he is now possessed of and half of the farm, that I purchased of Mr. Rogers and that land, that Goodman Jackman doth improve, from Merimack River downe to the meadow, my meaneing is from the river, until it doth come, as far as Mr. Phillips his meadow, or the peece commonly cald five acres, and the rest of that land, that Goodman Jackman doth hire, that is betweene  the sayd five acres, and Crane Meadow, to be equally, between my two, JOHN and JAMES.

BAILEY, JOHN

 

John Bailey, born Feb. 2, 1642, was a son of the first settler, James Bailey and his wife, Lydia.   He married Mary Mighill, June 16, 1668.   She was the daughter of Thomas and Ann Parrot Mighill.  Her birth was May 1, 1649.   Thomas Maghill, was one of the leading citizens of Rowley. 

 

They (I assume John and Mary) lived in Rowley, MA and had nine children, the last one born after his father's death.   John Bailey served as a soldier under General Phipps in the expedition against Canada in 1690, and perished coming from Canada, November 19, 1690.   His widow was appointed administratrix of his estate, as appears by the records of the probate court a Salem, MA.   She died about 1693.   

 

James Bailey born in 1680, was a son of John Bailey and Mary (Mighill) Bailey.   He lived in Bradford, MA.  He married first Hannah Wood, July 14, 1702.   She was born January 20, 1681, daughter of John Wood and Isabel Hazen.    Hannah wood Bailey died March 3, 1731-33.

 

He married second, Mrs. Mary Bacon, November 22, 1733.   This second marriage is cited as an instance in New England of what was known as smock marriages.   Smock marriages were weddings where the bride appeared dressed in a white sheet or chemise furnished by the bridegroom.   The reason of such a garb was the belief that if a man married a woman who was in debt he could be held liable for her indebtedness if he received any property with her.   Eventually all immodesty was avoided by the bridegrooms furnishing to the clothing worn at the wedding retaining title to the same in himself.   This was done in the presence of witnesses that he might prove the fact in case he was sued for any debts she might have contracted.   The following is a copy of the record in the case of the second marriage of James Bailey.

 

"Bradford, December ye 24, 1733.   This is to certify whomsoever it may concern that James Bailey of Bradford who was married to the widow Mary Bacon, November 22, last passed by me, ye subscriber, then declared that he took the said person without anything of estate and that Lydia, the wife of Eliazer Burbank and Mary the wife of Thomas Stickney and Margaret the wife of Caleb Burbank, all of Bradford, were witnesses that the clothes she then had on were of his providing and bestowing upon her.

James Bailey died early in 1769, leaving a will which was probated at Salem, MA, February 27, 1769.   He had 13 children, all by his first wife.

In the name of God Amen, This day of June Anno Domini 1765, I JAMES BAILEY of Bradford in the County of Essex and Province of Ye Massachusetts Bay in New England, yeoman, being weak in body but of perfect mind and memory, thanks be to God, and knowing that it is and Testiment, that is to say, first of all I recommend my soul into the hands of God who gave it, looking for His mercy through Jesus Christ unto eternal, and my body I recommend to the earth to be buried in decent Christian burial at ye discretion of my executors, herein after named, not doubting but at ye general resurrection I shall receive the same again by the mighty power of God.   As touching such worldly estate with which it has pleased God to bless me, I give, devise, and dispose of ye same in the following manner and form, viz;

 

Imprimis, I give and bequeath to my loving wife, Mary, all ye household goods she brought to me when I married her, together with all we have gotten since to keep them in repair and improvement of ye household goods.   I had my hose (house) when I married her, during ye term of her natural life, or so long as she will remain my widow, and for and during ye same term I will and order that she shall have that part of my dwelling hose in which we now live with half ye cellar and priveledges belonging to it, with two poles square of land for a garden where now improved and haif a cart load of dung broght and laid thereon yearly,  five cords of fire wood brought and laid as near the house as is convenient and cut up for fire, also seven bushels of Indian corn, three bushels of rye, one bushel and a half of mault, one pound of hopps, half a bushel of potatoes, four bushels of winter apes, and liberty to get what aples in the orchard to bake she shal have need of for her own use.   Also two barils of cyder, with barils to keep it in, one peck of beans, two pounds of cotton whool, tow pounds of flax well combed, four pounds of sheep's wool well washed, one hundred wait of port and eighty weight of beaf and use of one cow kept for her both in winter and summer convenient for her to milk.   As also the sum of one pound lawful money to be paid to her yearly by my executors.   As all the above articles are likewise intended to be, and if she shall be my widow my will is that she be decently buried at the expence of my executors;   I also give to my said wife all the corn and meat that I shall have in my house at the time of my death. 

 

Item:  I give and bequeath to my grandson, MICHA CARLTON, only child of my daughter, ABIGAIL CARLTON, deceased Five Shillings.

 

Also to my daughter HARDY (Hannah Hardy) five shillings,

 

Also to my grandaughter, HANNAH GROSS, a child of my daughter, MEHITABEL GOSS, five shillings. 

 

Also to my grandchildren, the children of my daughter EDNA GRIFFIN, five shillings to be divided among them. 

 

Item:  I give and bequeath to my daughter, MIRIAM TYLER, five shillings and to my daughter BULAH GRIFFIN, one pound, five shillings and eight pence, and to my daughter HEPSABAH BEAL, also one pound, five shillings, and 8 pence, all of said legacies to be paid by my executors as soon as may be after my decease.

 

Item:  I give and bequeath to my remaining son, STEPHEN AND JAMES, whom I likewise appoint and constitute my sole exectors of this my last will and testament, they paying all my just debts and paid and the legacies I have bequeathed in my last will and Testament to the, their heirs and assigns forever, all ye estate that I shall die of, both real and personal, not already given away in this my last will, to be equally divided between my two said sons, STEPHEN AND JAMES, or their legal representatives.   Therefore revoking and annulling all former wills, legacies, requests or ____ executors by me heretofore nameed in any wise whatsoever, I ratify ____ and confirm this and no other to be my last will and Testament.   In testimony whereof and here unto set my hand and seal ye day and year first above written.                                Signed             JAMES BAILY

JAMES BAILEY, died Feb. 27, 1769 in Bradford, MA

 

"James Bailey, born February 11, 1721-22, was a son of James Bailey and Hannah (Wood) Bailey of Bradford, Mas.   He was a ship carpenter.   He married first Rachel Berry about 1745.   He married second, Mary Kincaird.  His early married life was spent at Newburyport, Mass. and at Falmouth, Maine.  He afterwards moved to Haverhill, New Hampshire.   Still later he was one of the first settlers in Peacham, Vermont.   He served in the French War, having enlisted while living at Falmouth, Maine.  He was taken prisoner on Lake George, was carried to France and confined in a castle 19 months.   He was finally exchanged and sent to England.   From Thence he returned to his home at Falmouth.   He died at Peacham, Vermont about 1807.   He had eight children by his first wife and three by his second.  He married Rachel Berry 1745, Rachel Berry (1725-1765).   His occupation:  A baptist minister of Gorton, Rye, and Peacham, VT.   And married many of his own children and grandchildren.   He was also a Rev. War Patriot.   A Major in New Hampshire. "

Benjamin Bailey, son of James Bailey III and Rachel Berry was born May 25, 1760 in Newburyport, Essex County, MA.    A Revolutionary War solder, served as a drummer, 1781, in Capt. August 1776, was in Capt. Jonathan Ring's Co., Colonel Howard's Regiment, 6 weeks

 

December 1, 1778, under same Captain and Colonel, 3 months

 

In 1779 or May 1, 1780 while residing at Peacham, VT, he served as a private under Capt. Benjamin Stone for 3 months and as Sergeant under Capt. Ezekiel Ladd, one month 

 

May 1, 1781, he enlisted in Capt. Nehemiah Lovewell's Company, Colonel Benjamin Wait's regiment, Vermont Troops.   Guarded prisoners two months and was drum major six months, served until Jan. 1782.

 

Look in Groton VT for his leadership in the town.

 

"Smith Bailey, born in Peacham, Calendonia, VT, May 1, 1786, married April 14, 1806 Elizabeth Horton.  As I (this is not Linda's writing but an earlier researcher) am unable to find their marriage license.  Her family lived in West Haven, VT.   Her father was Jesse Horton and Nancy Potter.   Jesse Horton was a Rev. War soldier.  

 

Smith Bailey was a resident of Peacham, Gorton VT., Essex County New York, and Madison County, OHio.   Story is that he was dead in Madison Co. in 1834, Monroe Twp.   As I am unable to find his place of burial, I cannot accept this and am still looking.   Have found tax records in 1830 and have not found his occupation.   Elizabeth Horton Bailey was married the second time to Richard King in May 21, 1843, Evergreen Cemetery at Auburn, IN, but is buried on Benjamin Bailey's lot as S. Bailey.

If that is Elizabeth, wife of Smith, then she would have been 92 years old when she died and not 32.    That would make the 92 years and 19 days just about right, so probably that is the case.   Transcribed incorrectly either from the tombstone or an error in typing it off.

At the time the original researcher wrote this, they had not found any of the graves that were in Madison Co., Ohio.   She says that she did find Benjamin Bailey paying taxes in the county south of Madison but as yet had not gone to find out if Smith Bailey bought land there but apparently paid some taxes there.  Found Benjamin S. Bailey paid taxes in Jeffville, Ohio in 1839.

 

Benjamin S. Bailey, born January 14, 1814 Essex Co, Jay Twp., married Margaret Scott, daughter of Robert Scott and Elizabeth Frederick on November 1, 1840.   He died Oct. 5, 1887 in Jackson Twp., DeKalb County, IN.   Margaret Scott Bailey, born Oct. 31, `821, dead June 10, 1899 in Jackson Twp., DeKalb County, IN.   They are buried in Evergreen Cemetery in Auburn, IN.   (ABOVE)

Benjamin S. Bailey moved to Washington Twp., Noble County, IN and bought land in Jackson Twp., DeKalb County at Fort Wayne, IN, August 27, 1840 and the Indians helped him build his cabin.

BAILEY, BENJAMIN

 

            "The Old Must Die"

 

BENJAMIN BAILEY was born in Essex County, New York, January 11, 1814.   Here he passed the early part of his childhood, amid the grand and picturesque scenery of the Adirondack mountains, a place which is destined to produce and develop manhood in the highest degree.   At the age of 16 years he removed with his father and family to Madison County, Ohio.   Here he took an active part as one of the young and heroic pioneers, for which, that and the adjacent vicinity was so famous. 

 

In 1839 he turned his attention to the land still farther westward and thus it was that he became one of the sons of toil in our own grand state.   In 1841, he married MARGARET SCOTT, who was a young and estimable lady, residing with her parents near Wolf Lake, Noble County, Indiana.   He then moved to Fort Wayne, which was then nothing more than a mere trading post.   The following year he moved on the old homestead which has ever been so dear to him, and which he redeemed from the primeval forest which the country at that time mostly consisted of. 

 

During their married life 13 children were born them;  5 boys and 8 girls, 12 of whom and the faithful wife and mother mourn his loss.   He departed this life, October the 4th, 1887, aged 73 years, 8 months and 22 days.  

 

Characteristics of the deceased:

            He was a loyal citizen in the broadest sense of the term.

            He never lost an opportunity in helping his fellow-men.

            He was a faithful husband and a loving father and

            Always gave every other man all the privileges he claimed for himself.

 

Life is a narrow vale between the cold and barren peaks of two eternities.  In the gloom of death, hope sees a star, but again all hopes are baffled and the billows roar over a sunken ship.   In all the years that are gone, in all the years that are to come, there never was and never will be a stronger loving manlier man.

ROBERT S. BAILEY

 

Enlisted Jan. 1, 1864, at Indianapolis, Ind., at the age of 22 years as a private in Co. H, 30th Ind. V.I. 3rd Brig., erd Div., 4th A.C., and October, 1864, he was transferred to Atlanta, Ga., to Co. C, 3rd Ind. V.I.

 

In February, 1864, he was in hospital at Chattanooga Six weeks and

Marietta, Ga., In July, of same year for three weeks;

he was detailed as guard to wagon train and teamster in October, 1864, at Altoona Pass for 4 months,

 

He took part in the battles of Rocky Face Ridge, Buzzard Roost, Resaca, Marietta, Atlanta, Siege of Columbia, Franklin, Sherman on his march to the sea, Nashville, Peach Tree Creek, Kinston and Kenesaw Mt.,

 

receiving an honorable discharge Nov. 22, 1865, at Indianapolis, Ind.

 

A brother, ALEXANDER BAILEY, served in 152nd Ind. V.I. 

 

Comrade Bailey was born Dec. 9, 1841, in Noble County, Ind., and settled in DeKalb County, same state in Januiary, 1843, with his parents, where he received his early education;  his father, BENJAMIN BAILEY, is deceased, but his mother, MARGARET (SCOTT), is yet living (1894).  Comrade Bailey has application for pension now on file.  He is engaged in farming with address at Spencerville, Ind.
